Why State-Specific Knowledge Matters

Notary law is entirely state-specific. There is no federal notary commission, no federal notary journal requirement, and no federal standard for what constitutes acceptable identification for a notarization. Each of the 50 states and the District of Columbia has its own statutes, its own commission requirements, its own acceptable ID standards, and its own approach to electronic and remote notarization. For signing agents who work across state lines or who are building expertise in a specific market, this state-by-state variability is not a complication to be ignored — it is the foundation of professional competence.

The most consequential state-by-state differences for signing agents are: journal requirements (California, Nevada, and Georgia require journals; most states do not), thumbprint requirements (California uniquely requires a right thumbprint for real property documents), RON authorization status and retention requirements (ranging from not authorized to 10-year retention periods), acceptable ID standards (most follow the national RULONA standard, but several have state-specific variations), and notarial certificate language requirements (California has a mandatory two-part certificate; Texas requires county of commission on the certificate).

RON Authorization: A Moving Target

Remote Online Notarization authorization has been one of the fastest-evolving areas of notary law. In 2017, only one state (Virginia, since 2011) had authorized RON. By 2020, roughly 20 states had authorized it. By 2023, nearly all 50 states and D.C. had some form of RON authorization. California — notably — was among the last major states to authorize RON, doing so effective January 1, 2023.

RON retention requirements also vary significantly: most states require 5 years, but several New England states (Maine, New Hampshire, Rhode Island, Connecticut, Vermont, Massachusetts) require 10 years, Colorado requires 10 years, and Nevada requires 7 years. These differences matter for platform selection — verify your RON platform meets your specific state's retention requirements before performing any remote sessions.

The RON Landscape in 2025

As of 2025, virtually all 50 states and D.C. have authorized Remote Online Notarization. The variation is in retention requirements: most states require 5 years for RON electronic journals and audio-visual recordings. New England states (Maine, Massachusetts, New Hampshire, Rhode Island, Connecticut, Vermont) and Colorado require 10 years. Nevada requires 7 years. California — one of the last major states to authorize RON — requires 10 years following its January 2023 authorization. These retention differences directly affect which RON platform you should use, since you need a platform that explicitly certifies compliance with your state's specific retention period.

RON authorization does not guarantee lender acceptance. Even in states with years of RON history, individual lenders can require in-person notarization for specific loan types.
